Regular City
Council Meeting
October 28, 2002
CALL TO ORDER
Regular meeUng of the City
Council, City of Eskridge,
Kansas, was held Monday,
October 28, 2002, 7:00 p.m. at
City Hall with Mayor Kraus
presiding.
ROLL CALL
C. Turnbull, D. Williams, C.
Bowers and D. Mercer were
present. Also some others that
were present were City
Attorney Gary Hanson, City
Treasurer Janice Turnbull,
and City Clerk Joe Elliott.
AGENDA
At 7:20 p.m., D. Williams
moved to approve the agenda
with additions, C. Turnbull
seconded and all aye. Motion
carried.
MINUTES
At 7:21 p.m., the regular
meeting minutes for October
14, 2002 was presented. C.
Turnbull "moved to approve
the minutes with suggested
changes. D. Mercer seconded
and all aye. Motion carried.
APPROPRIATION
ORDINANCE
At 7:24 p.m., additions to
appropriation ordinance
#1263 was presented. After
careful examination and dis-
cussion, C. Turnbull moved to
approve appropriation ordi-
nance #1263, D. Williams sec-
onded and all aye. Motion
carried.
PUBLIC CONCERNS
AND COMMENTS
At 7:28 p.m., T. Fanning
spoke of the Wabaunsee Pines
Golf Course and their plans to
procure funds for its comple-
tion. The City Attorney had
discussed the lease situation
with T. Fanning before the
• meeting and pretty much had
it all worked out. He advised
Fanning to seek their financ-
ing as long as it was with the
a proval ofthe City Council
and followed the guidelines of
the lease contract. No action
taken.
DEPARTMENTAL
REPORTS
At 7:32 p.m., Rex Turnbull
gave a progress report on the
water plant but reported very
little progress happening with
contractors. Mayor and D.
Williams were to look into
what is holding up the project.
Also, the question as to what
is to be done with the old wa-
ter tower and the City Clerk
stated that to restore the old
tower would cost the City
$28,600. It had been men-
Uoned by the engineer that the
old tower may not be needed
now, but this involves moving
the electronic measuring
equipment over to the new
tank before it can be elimi-
nated. The Clerk and Rex was
to look into the cost of moving
the electronics.
At 7:35 p.m., D. Mercer gave
a brief report on streets for
her husband that was not able
to make the meeting, saying
that 2nd Avenue had been
sealed and marking of the
streets.
CITY BUSINESS
At 7:39 p.m., Rex Turnbull
introduced a permit applica-
tion for a combination shelter
house and shed measuring
12'x14' made by Michael
Rhoads. D. Williams moved to
approve the structure, C. Bow-
ers seconded and all aye. Mo-
tion carried.
At 7:41 p.m., D. Fox ar-
rives.
At 7:41 p.m., Rex Turnbull
advised that there was a prob-
lem noticed at the lake where
there was a fuel line running
across the property from a 300
gallon tank to near the lake's
edge belonging to a Mark
Shulte. There was some con-
cern that this was not a good
idea to have fuel near the wa-
ter where it could be entered
into the water in case of a
break or vandalism. Rex was
to contact the owner and talk
to him. No action taken.
At 7:45 p.m., the City At-
torney advised that on 12-10-
2001, the City had issued a
"Certificate of Occupancy~' to
the Prairie Winds Apartments
and needed to have it revoked
retro active to that date. The
Prairie Winds Apartments are
to be modified to suit a differ-
ent kind of renter with age not
an issue at a reasonable rate
with the financial help of sev-
eral government agencies. C.
Turnbull moved to revoke the
Certificate of Occupancy is-
sued by the City of Eskridge
on December 10, 2001. Autho-
rization of occupying of
Prairie Winds Apartments is
hereby revoked retroactive to
December 10, 2001, on the ba-
sis of the lack of suitability
for occupying that facility. C.
Bowers seconded and all aye.
MoUon carried.
At 8:00 p.m., Ordinance
$480 was presented for the
changing of the times and
days in which Council meet-
ings are to be- held. D.
Williams moved to approve
having a meeting once a
month on the first Monday at
6:30 p.m. and D. Fox seconded.
Roll call vote: C. Turnbull yea,
C. Bowers yea, D. Williams
yea, D. Mercer yea, and D. Fox
yea. Motion carried.
At 8:09 p.m., City Clerk ad-
vised that we had another bid
of $4,200 to repair the north
side of the City Hall building
and that another bid was ex-
pected. No action taken.
OTHER COUNCIL
BUSINESS, NEW OR
CONTINUING- PERSONNEL
At 8:10 p.m., Mayor Kuntz
of Harveyville had sent a
letter to the Eskridge Mayor
and Council requesting to
renew the law enforcement
contract until January 2003.
The Council discussed the
request and the use of the
spare patrol care for such
patrol. D. Mercer moved to
approve the extension on the
contract and the motion died
lacking a second. Subject to be
discussed at the next meeting:
No action taken.
At 8:19 p.m., D. Williams
and her husband signed a
petition to annex 8 acres of
their land that includes one
house. Mayor Kraus suggested
a fiat fee of $500 for a hookup
fee of city utilities that
included installation of sewer
pump, gas and water. The
Williams said that they
planned on putting a large
house on the property,
totaling two houses along with
the 8 acres that will be on tax
rolls for the city. D. Fox
moved to approve Ordinance
#481 to annex this property
and D. Mercer seconded.
MoUon carried with 3 yea and
D. Williams and C. Turnbull
abstaining. Motion carried.
At 8:38 p.m., D. Fox
presented Ordinance #482 that
dealt with the keeping of
animals in the City. After
debated the subject for a
while, C. Turnbull moved to
approve Ordinance #482 and
D. Fox seconded. All voted yea
excpet D. Mercer nay. Motion
carried.
At 8:52 p.m., D. Mercer
brought a modified lease for
the Caretaker house at Lake
Wabaunsee to accommodate
Debra Ponton until she can be
offered a new contract in
April of next year to include
the house. The lease included
such things as in lieu of the
monthly $400 rent, she could
work 12.5 hours per week in
the park or other city work.
The City Attorney said that
this would be the same as
another employee and would
have to pay employment taxes
and etc. Discussion is to
conUnue at the next meeting.
No action taken.
MAYOR - COUNCIL
CONCERNS & COMMENTS
At 9:08 p.m., D. Mercer
stated that the candy cane
Christmas decorations were a
bit frayed and needed some
rebuilding. The Council di-
rected Joe Mercer to look for
material to restore one of
them shortly to see what the
cost is involved. No action
taken.
At 9:13 p.m., Mayor Kraus
said that he liked what the
volunteers did for the City
park gazebo by installing the
wheel chair ramp and sug-
gested that the City prepare a
certificate of appreciation. He
also stated that he thought the
Fall Festival went very well
this past weekend. No action
taken.
ADJOURN
At 9:24 p.m., D. Williams
moved to adjourn. C. Turnbull
seconded and all aye. Motion
carried.
