Page 24 The Wabaunsee County Signal.Enterprise KANSAS SUPREME COURT UPHOLDS TAX APPEALS ISSUE FOR LIETZ CONSTRUCTION cont. trom page one Bobby Miller said when the case advanced to the Supreme Court level he enlisted the help of other county governments. "I knew it would be expensive. We took the view that excavating and earth-moving equipment is not the traditional kind of machinery or equipment, such as combines or tractors, used to cultivate the land or otherwise produce farm products," said Miller. Miller went on to explain he sent notice to all 105 counties advising them of the upcoming Wabaunsee County case. He informed them that there were over 100 similar cases pending statewide. Wabaunsee County's case was the first to make it to the Supreme Court. "I told them that the outcome of the Wabaunsee County case would no doubt determine the outcome of similar cases originating in other counties," said Miller. As a result of Miller's request Wilson, Dickinson, Osage, Lyon, Sumner, and Marshall counties rallied behind Wabaunsee County's cause and contributed over $4,000 for attorney fees. Miller said approximately $12,000 has been spent on attorney fees. "Since the Supreme Court made their ruling; we contacted the Wabaunsee County Soft Conservation Office and obtained a list of all equipment owners in Wabaunsee County that perform soil conservation work," said Miller. "Those property owners will be advised of their tax exemption, and we'll remove their property from the tax roll," he added. Miller said that list includes 15 contractors in Wabaunsee County with over $500,000 appraised value of equipment. Miller went on to say that technically the problem is with the wording in the statute that effects this equipment. "In 1997. in an effort to clarify exempt farm machinery, legislators removed wording from a statute, The original wording was that an item was exempt if it was 'exclusively for farm and ranch work.' They replaced that wording by saying, an item was exempt if it was 'actively and regularly' used for farming or ranching. What's active_and what's regular? It made it pretty muddy," he continued. Miller said he felt the only recourse Kansas counties have now will be to influence legislators to clean up the language in the statute to make it clearer and more precise. "It will have a big impact statewide. Every day you read about revenues being lower than projected. If more items continue to be exempt, that is bound to happen. The more you shrink the tax base the more it falls upon real estate. Taxpayers that own real estate are continuing to get a bigger portion of the tax bill," said Miller. Merle Lietz commented on the Supreme Court's ruling by saying, 'q'his is the first time this issue has been tested by the Supreme Court, and they have spoken. I wouldn't be surprised if, as a result of this, the law will be rewritten."
