ORDINANCE NO. 376
AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON CERTAIN PROP-
ERTY TO PAY THE COSTS OF INTERNAL IMPROVEMENTS IN THE CITY OF
ALMA, KANSAS, AS HERETOFORE AUTHORIZED BY RESOLUTION NOS. 99-1
AND 2000-5 OF THE CITY; AND PROVIDING FOR THE COLLECTION OF
SUCH SPECIAL~SSESSMENTS.
WHEREAS, the City Council of the City of Alma, Kansas (the "City") has
heretofore authorized certain internal improvements (the "Improvements") to be
constructed pursuant to K.S.A. 12-6a0 1 et seq. (the "Act"); and
WHEREAS, the City Council has heretofore conducted a public hearing in ac-
cordance with the Act and desires to levy assessments on certain property bene-
fited by the construction of the Improvements.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE
CITY OF ALMA, KANSAS:
SECTION 1. Levy of Assessments. For the purpose of paying the costs of
the following described Improvements:
Project No. I - Park Valley Addition - Sanitary Sewer Improvements (A)
Resolution No. 99-I {]Project A)
Construction of a sanitary sewer collector manhole and piping, wet well, and
lift station in Park Valley Addition to the City of Alma and a force main sewer line
from the lift station to the existing sewer line in the City of Alma near the east
end of 4TM Street, and appurtenances;
Project No. 2 - Park Valley Addition - Sanitary Sewer Improvements (B)
Resolution No. 99-1 (Project B)
Construction of a sanitary sewer collection system of lines, manholes, service
connections, and appurtenances for the collection of sanitary sewage for Lots 8
through to 32, inclusive and Lots 38 and 39 in Park Valley Addition to the City of
Alma;
Project No. 3 - Park Valley Addition - Street Improvements
Resolution No. 99-1 (Project C)
Construction of asphalt .roadway with curb and gutters on the following
streets in the City of Alma, Kansas: Mill Valley Street from Union Street to the
North line of Lot 39, Parkview Street from Mill Valley Street to the South line of
Lot 52, and all of Willow Court and Redbud Court in Park Valley Addition to the
City of Alma;
Project No. 4 - Park Valley Addition - Storm Drain Improvements
Resolution No. 99-1 (Project D)
Construction of storm drain lines with inlet structures, and a surface water
detention area in Gnadt Park in the NE comer of Park Valley Addition to the City
of Alma;
Project No. 5 - Park Valley Addition - Water Improvements
Resolution No. 99-1 (Project E)
Construction of water lines, meter settings, fire hydrants, and appurtenances
to serve all of Park Valley Addition to the City of Alma with potable water, and fire
protection;
Project No. 6 - Street and Storm Drainage Improvements
Resolution No. 2000-5 (Project A)
Construction of storm sewer curb and guttering, and other necessary drain-
age, and further improve with sub-grade modification and asphalt surface, the
following streets in the City of Alma, Kansas: Ohio Street (extended) from First
Street to Highway K-99, but limited to the South 216' for curb and gutter on the
East side; Ohio Street from First Street to Third Street; First Street from Ohio
Street to Missouri Street (except curbing only from Ohio to former Topeka State
Road (extended) on the south side, and from former Topeka State Road to Mis-
sour/on the North side); First Street, curbing for approxilnately 75' on South side
from the West line of C. Herman property East to meet the existing curb; Second
Street from Missouri Street to alley one-half block East of Ohio Street; Second
Street from Missouri Street to Kansas Street, with curb only on North side; Sec-
ond Street from Iowa Street East approximately one-half block, curbing only 60
feet on South side; Third Street from Iowa West to Nebraska Street with curb only
on the South side; Iowa Street from Third Street to Second Street; Fifth Street
and Sixth Street from Iowa Street to Nebraska Street; Nebraska Street from Fifth
Street to Seventh Street and from Ninth Street North to the North City Limits;
Tenth Street from Nebraska Street to Lyndon Street; Kansas Avenue from Elev-
enth Street, South to the South line of Stuewe Addition; Grand Avenue from
Eighth Street to Ninth Street; Illinois Street from Seventh Street to Ninth Street;
Eighth Street from Illinois to Highway K-99; Ninth Street from Grand Avenue,
East to a point approximately 100 foot West of Highway K-99; and Darcy Street
from Kent Street, East to East Line of Lots 6 and 13 Baldock's Second Addition;
Project No. 7 - Tenth Street Improvements
Resolution No. 200-5 (Project B)
Replace curb and guttering storm drainage and resurface with asphalt sur-
facing the following street in the City of Alma, Kahsas; Tenth Street from the
West line of Lyndon Street, to Kansas Street;
There are hereby levied and assessed the amounts (with such clerical or ad-
ministrative amendments thereto as may be approved by the City Attorney)
against the property described on Schedules I & ]I attached hereto.
S]~TION 2. Payment of Assessments. The amounts so levied and assessed
in Section I of this Ordinance shall be due and payable from and after the date of
publication of this ordinance. Such amounts may be paid in whole or in part on
or before July 8, 2002.
S]tJ2TION 3. Notification. The City Clerk shall notify the owners of the
properties described in Schedules I & H attached hereto insofar as known to
said City Clerk, of the amounts of their respective assessments; and, said notice
shall further state that unless such assessments are paid on or before July 8,
2002, bonds will be issued therefore, and the amount of such assessment will be
collected in installments with interest. /
S]~TION 4. Certlflcation. Any amount of special assessments not paid
within the time prescribed in Section 2 hereof shall be certified by the City Clerk
to the Clerk of Wabaunsee County, Kansas, in the same manner and at the same
time as other taxes are certified and will be collected in 15 annual installments,
together with interest on such amounts at a rate not exceeding the maximum
rate therefore as prescribed by the Act. Interest on the assessed amount re-
maining unpaid between the effective date of this Ordinance and the date the
first installment is payable, but not less than the amount of interest due during
the coming year on any outstanding bonds issued to finance the Improvements,
shall be added to the first installment. The interest for one year on all unpaid in-
stalhnents shall be added to each subsequent installment until paid.
SECTION 5. Effective Date. This Ordinance shall take effect and be in force
from and after its passage, approval and publication once in the official City
newspaper. '*"
