Adams administered the Oath
of Offices to Sandra Lemon.
PUBLIC COMMENT:
I. Deann Wood requested a
zoning variance and building
permit in order to build a
fence in her back yard. Coun-
cil asked her to visit with her
neighbor in order to come to
an agreement between the two
of them regarding the place-
ment of the fence. Consensus
of Council was that Blevins
should approve the building
permit with the 17-foot vari-
ance.
2. Curtis Havenstein re-
quested a variance and build-
ing permit for the construc-
tion of a garage. Consensus of
Council was that Blevins
should approve the building
permit with the 18-foot vari-
ance.
3. Jim Healey: Spoke on
numerous topics.
CONTRACT:
1. Jack Turner, City Attor-
ney, and Bill Baldock, Ass.is-
fant City Attorney. Barnes
made the motion that Council
give Mayor Adams Ill the au-
thority to sign the agreement
with Jack Turner for May 1,
2002, to May l, 2003, contract
year, after striking the follow-
ing wording from the last sen
tence in paragraph l: (and
contemplates that I will have
the exclusive privilege of han-
dling the legal services involved
in issuance of any no-fund war
rants, temporary notes or im-
provement bonds which the City
may issue), Berroth seconded
the motion, and it passed, 5-0•
APPROVAL OF THE MIN-
UTES: Berroth made the mo-
tion to approve the minutes
for the April 17, 2002 Special
Meeting as written and to ap-
prove the minutes for the
April 8, 2002 Regular Meeting
as written, and with the fol-
lowing changes: Page 1 under
Sewer/Trash Departments

with "installed" and the words
"lightning rods" with "surge
protector". Page 2 under Park
& Recreation Departments -
Motion made by Blevins to

TREASURER'S REPORT

mitted for their review.
2. Approval to pay April
bills. Blevins motioned to ap-
prove the April bills as pre-

motion, and it passed, 5-0.
3. Amended 2002 Budget
(Wycoff). Wycoff answered
Council's questions pertaining
to the 2002 Budget Amend-
ment. Tomorrow, May 7, 2002,
he will fax it to .The Wabaun-
see County Signal-Enterprise
for publication. The Special
Meeting for the Public Hearing
and approval of this budget
amendment will be held on
May 29, 2002, at 7:00 p.m. at
City Hall.
MAINTENANCE REPORT:
1. P. Lemon reported that
there is a need for an addi-
tional overhead door to be in-
stalled in the City Shop,
which would allow easier ac-
cess to the Westside of the
shop and allow for better
storage of large equipment.
The cost of this addition will
be approximately $1500 in-
stalled. Barnes gave his ap-
proval to install another
overhead door in the City
Shop Building.
SENIOR CENTER REPORT:
1. Status Report: Barnes
instructed S. Lemon to contact
Donna Crawford and inquire
about the delivery date of the
final draw In the amount of
$1,200 and find out If it is
necessary to wait for the de-
livery of that money prior to
signing over the deed to the
Senior Center.
2. Proposal (Oliver)Oliver
proposed the addition of a
parking area on the north side
of the New Senior Center. She
asked what the City would do
to help the Senior Center
make the construction of this
new parking area possible. It
was the consensus of Council
to table this subject until the
June 3rd regular Council
Meeting.
DEPARTMENTAL RF_,-
PORTS:
Sewer/Trash Departments:
I. Exodus Contract. The
proposed contract reads ex-
actly the same as last year's
contract except for the neces-
sary date change. Barnes mo-
tioned to authorize Mayor
Adams Ill to sign the Exodus
Disposal contract for one year
with the ex ft same terms as
last year's contract except for
the change of dates. Blevins
seconded the motion and it
passed, 5-0.
Water Department and
Street Department:
. Ordinance #2002-01; Reso-
lution #R2002-02; Resolution
#R2002-03 and the Ranson
Financial Consultant Con-
tract were reviewed and dis-
cussed by Council. Joe Berroth
motioned to pass Ordinance
#2002-01, Resolution #R2002-
02, Resolution #R2002-03 and
the Ranson Financial Consul-
tant Contract, subject to ap-
proval by Jack Turner, City
Attorney, and to authorize
Mayor Art Adams Ill to sign
all the necessary paperwork.
Dick Barnes seconded the mo-
tion and it passed, 5-0.
Park and Recreation De-
partments:
1. Oliver requested a vari-
ance from the City, which
would allow Tom Mayer to
drive his 4-wheeler (ATV) be-
tween his home and the park.
This would enable him to use
the ATV while working at the
ball diamond. It was the con-
sensus of Council to have
Berroth check into the State
laws pertaining to the opera-
tion of ATV's on City streets.
2. There was general dis-
cussion pertaining to the
Parks Department, the Recre-
ation Association, and the
Park Fund. It was the consen-
sus of Council that the City is
in charge of the Park Depart-
ment,
a community volunteer
is to run the Recreation Ass'o-
clation, but must be in contact
with the Council Member in
charge of the Park Department
and that the Park Fund, also
run by a community vol-
unteer, was organized in order
to raise money for the pur-
chase of new playground
equipment for the City Park
playground area.
Oliver then stated that
there is some confusion with
the scheduling of reservations
for the shelter house, park
and ball diamond. It was the
consensus of Council that the
head of the Park Department,
Shirley Oliver, would be the
person to contact for reserva-
tions of the park, shelter
house and ball diamond.
Blevins motioned that
Council rescind its previous
request for the financial
records from the Recreation
Association with the under-
standing that Shirley Oliver
will work with the Recreation
Association with volunteers
and then bring a report back
to Council. Barnes seconded
the motion'and it passed 5-0.
Z o n i n g Department:
Blevins reported that he had
issued one building permit. It
was the consensus of Council
that Blevins should discuss
this building permit with the
City Attorney and then act ac-
cordingly.
Police Department: Berroth
had nothing to report.
Utility Billing Clerk's Re-
port: S. Lemon reported that
there would be five disconnec-
tion notices sent out this
month.
Municipal Court Report: S.
Lemon reported that Munici-
pal Court was held on April
16, 2002, and that the next
Court date Is scheduled Ior
May 21, 2002, at 8:00 p.m.
OLD AND NEW BUSINESS:
1. Review of the Codifica-
tion Draft is tabled until Oc-
tober 2002.
ADJOURN: Blevins mo-
tioned to adjourn the meeting
at 9:45 p.m. Barnes seconded
the motion, and it passed, 5-0.

MEMBERS PRESENT:

Blevins were not present.
QUORUM ESTABLISHED:
Mayor Art Adams Ill called
the meeting to order at 7:00
p.m.
Denny Wycoff explained the
accounting system and how
the two different accounting
options could be used to record
the expenditures of the Bond
money. It was the consensus
of Council to use the Capital
Project Fund option. Wycoff
then informed the Council
that the proposed 2002 Budget
Amendment would not be nec-
essary since they had decided
to use the Capital Project
Fund accounting option.
It was the consensus of
Council that they would not
amend the 2002 Budget at this
time.
MOTION TO ADJOURN:
Dick Barnes motioned to ad-
journ the meeting. Frank May
seconded the motion, and it
passed, 3-0. Meeting adjourned
at 7:30 p.m.

There were two sealed bids
received prior to this meeting.
Dick Barnes opened and read
the bids for the street project.
The total bid from each com-
pan), were: Andrews Asphalt
$43,307.59; and High Plains
Construction $54,471.29.
Due to the absence of
Councilman Joe Berroth, the
bids for the water project will
be presented at the regular
City Council meeting sched-
uled for June- 3, 2002, at 7:30
p.m.
MOTION TO ADJOURN:
Dick Barnes motioned to ad-
journ the meeting and note
that no action was taken at
this meeting. Frank May sec-
onded the motion and it
passed, 3-0. Meeting adjourned
